These Terms & Conditions (“Terms”) govern the use of services provided by T&J Legacy Transportation(“Company,” “we,” “us,” or “our”), including Non-Emergency Medical Transportation (NEMT), airport transfers, short-distance transportation, and long-distance transportation. By booking, scheduling, or using our services, you agree to be bound by these Terms.
1. Services Provided
T&J Legacy Transportation provides scheduled, non-emergency transportation services only, including:
- Non-Emergency Medical Transportation (NEMT)
- Airport transfers
- Short-distance rides
- Long-distance rides
Important Notice: We do not provide emergency medical services, medical care, or medical supervision. In the event of a medical emergency, call 911 immediately.
2. Eligibility
- Passengers must be at least 18 years of age, or be accompanied or represented by a legal guardian or authorized caregiver.
- NEMT services require valid MassHealth eligibility and authorization, where applicable.
3. Booking & Scheduling
- All transportation services must be scheduled in advance.
- Clients are responsible for providing accurate and complete information, including pick-up and drop-off locations, appointment times, and any special transportation needs.
- T&J Legacy Transportation is not responsible for missed rides, delays, or service disruptions resulting from incorrect or incomplete information.
4. Driver Wait Time
- Drivers will wait up to 15 minutes past the scheduled pick-up time at no additional charge.
- If the client does not arrive within 15 minutes, the ride will be cancelled.
- Clients are responsible for being ready and present at the pick-up location on time.
5. Cancellations & No-Shows
5.1 NEMT (MassHealth)
- Free Cancellation: At least 2 hours before the scheduled pick-up time.
- No-Show: Failure to arrive or cancel within the allowed window will be recorded as a no-show and reported to MassHealth.
- Repeated no-shows may affect future scheduling or eligibility.
5.2 Private, Airport, Short- & Long-Distance Rides
- Free Cancellation: At least 24 hours before scheduled pick-up.
- Late Cancellation: Less than 24 hours’ notice will incur a 50% charge of the ride cost.
- No-Show: The full ride amount will be charged.
6. NEMT & MassHealth Services
- NEMT services are limited strictly to approved medical appointments.
- Only the minimum necessary information required to provide transportation is collected, in compliance with HIPAA, MassHealth regulations, and Massachusetts privacy laws.
- We do not collect or disclose medical diagnoses or treatment details.
- MassHealth coverage does not guarantee service if eligibility or authorization cannot be confirmed.
7. Privacy & Confidentiality
- All personal and health-related information is handled in accordance with our Privacy Policy.
- SMS, phone calls, and mobile communications are used solely for service-related purposes and are never shared with third parties.
- For NEMT clients, all data is collected, stored, and transmitted in compliance with HIPAA and MassHealth program requirements.
8. Client Responsibilities
Clients agree to:
- Be ready at the scheduled pick-up time
- Provide safe, accessible pick-up and drop-off locations
- Follow all vehicle safety rules, including seatbelt use
- Treat drivers and staff with respect
Failure to comply may result in service refusal or termination.
9. Liability
- Transportation services are provided “as is.”
- T&J Legacy Transportation is not responsible for lost, stolen, or damaged personal items.
- Clients assume responsibility for following all driver instructions and vehicle safety rules.
10. Refund Policy
Private, Airport, Short- & Long-Distance Rides Only:
- Full refunds for cancellations made within the 24-hour free cancellation window.
- 50% refund for late cancellations (less than 24 hours’ notice).
- No refunds for no-shows.
Refunds are processed to the original payment method within 5–7 business days.
11. Modifications
T&J Legacy Transportation reserves the right to modify, suspend, or terminate services at any time. Updates to these Terms will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved under Massachusetts law.
